Analysis of Detention of Foreigners Print E-mail

Organization for Aid to Refugees has recently issued an analysis of detention of foreigners, that surveys in detail situation of foreigners who are held in detention centre Bělá-Jezová in order to be expelled.
OPU found that protection of some of the human rights of foreigners remains theory. The worst is probably the fact, that foreigners, including women or families with children, are held here only on decision made by Czech Foreigners Police. Court review comes after long months of waiting, if ever.
According to the Analysis detention of foreigners is often in breach of the international law and must be changed. OPU criticised above all the fact that children with parents must stay in detention for 6 months, unaccompanied children then for 3 months on the basis of an administrative offence - not a crime. "Such a strict punishment - deprivation of freedom of movement is not envisaged in the criminal law for the commission of a range of crimes." said Martin Rozumek, Director of OPU.
In addition, the Czech priority of readmission agreements over the Asylum Act is in breach of international law because a large number of foreigners in detention is deprived of the right to submit asylum application. "Nowadays, when the EU signed a readmission agreement with Russia - a large producer of refugees every year - is such a situation unacceptable" added Mr. Rozumek.

OPU expressed its support to the legislative proposal submitted by MEP´s Bebarová-Rujbrová, Bublan and Maršíček. The proposal aims at standardizing visa procedures at Czech Embassies abroad. More details (in Czech) see in the attachment .

The quaterly Hostis is published by the Organization for aid to refugees with financial support of the Open Society Fund. The aim of this periodical is to inform both laics and professionals about issues concerning refugees and asylum. It includes analyses of selected areas of the asylum law, comments on actual asylum-connected issues in the Czech Republic and short news from countries of origin. It is published in Czech.

OPU critizes the proposed amendment to the Asylum Act Print E-mail

Organization for Aid to Refugees (OPU) sent to the Ministry of Interior its objections to the proposed amendment of the Asylum Act. OPU is against the proposed changes in the asylum procedure at the airport which are considered as a reaction to the recent violent escape of Egyptian asylum seekers from the detention center in Velké Přílepy near Prague. The proposed procedure, if enacted, would have to be seen as an unfair administrative procedure. Ministry proposes to limit the access of refugees to legal aid as well as make it impossible for them to keep their mobile phones with them. The Ministry also proposes to appoint the Regional Court in Prague as the only competent court to deal with any legal actions against the negative asylum decisions of the Ministry since the Regional court surprisingly speedily rejects all claims of refugees. In principle, OPU disagrees with establishment of a special regime for refugees at the airport. OPU points out that in last years no one single refugee at the airport has been granted asylum and a number of asylum cases are rejected within few days with an aim to deport the claimant by the earliest available plane back to his/her country of origin. OPU is going to approach with its comments also the members of the Czech Parliament.
